BOAT RENTAL WAIVER AND LIABILITY AGREEMENT

Waterside Resort – Lake Hamlin, Ludington, Michigan

This Boat Rental Waiver and Liability Agreement ("Agreement") is entered into on the date signed below by the undersigned renter ("Renter") in favor of the boat owner, operator, or rental company ("Owner").

1. ACKNOWLEDGMENT OF RISKS

Renter understands and acknowledges that boating and water-related activities involve inherent risks, including but not limited to:

Personal injury, illness, or death
Drowning
Collisions with other vessels, objects, or individuals
Equipment failure or malfunction
Changing weather and water conditions
Operator error or negligence (including that of the Renter or others)

Renter voluntarily assumes all risks, both known and unknown.

2. RELEASE OF LIABILITY

Renter, on behalf of themselves and their heirs, assigns, and representatives, hereby releases, waives, and discharges Owner from any and all claims, liabilities, damages, costs, or expenses arising out of or related to:

Personal injury or death
Property damage
Loss or theft of personal belongings
Any incident occurring before, during, or after the rental period

This release includes claims based on negligence to the fullest extent permitted by law.

3. INDEMNIFICATION

Renter agrees to indemnify and hold harmless Owner from any claims, damages, liabilities, or legal actions brought by third parties resulting from:

Renter's use or operation of the boat
Actions of passengers or guests
Violations of laws or regulations

4. RESPONSIBILITY FOR DAMAGE

Renter accepts full financial responsibility for any damage to the boat, equipment, or third-party property during the rental period, regardless of fault. This includes:

Repair costs
Replacement costs
Loss of use
Associated fees

5. OPERATION AND COMPLIANCE

Renter agrees to:

Operate the boat safely and responsibly
Follow all local, state, and federal boating laws
Not operate the boat under the influence of drugs or alcohol
Ensure all passengers follow safety rules
Use required safety equipment (including life jackets)

6. MEDICAL AUTHORIZATION

In the event of injury or emergency, Renter authorizes Owner to obtain medical treatment on their behalf if necessary and agrees to be responsible for all associated costs.

7. CONDITION OF EQUIPMENT

Renter acknowledges that the boat and all equipment have been inspected and are in good working condition prior to use. Any existing damage must be reported before departure.

8. NO WARRANTIES

The boat is provided "as is," without warranties of any kind, express or implied.

9. SEVERABILITY

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the state in which the rental occurs.

11. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and supersedes any prior agreements or understandings.
